What about refunds?
As part of the terms of buying this wholesale membership, TopSurfer asks that members do not make refunds. The reason for this is so people don't just get the membership, buy the wholesale credits and then request a refund from the person who sold them the wholesale membership.
So, once you buy it, use it, and if you don't want to continue then do nothing and your wholesale membership will expire.
This general rule is set up to protect all the sellers.
What if the person who referred me to TopSurfer is not a wholesaler?
Then the program will skip up to the person who refered that person until it finds someone who is a wholesale member(up 4 levels). If there is no one above you that is a wholesale member (in the 4 levels), then you will be able to buy wholesale access directly from us at TopSurfer.
But don't worry, the program will automatically find someone for you to buy it from.
How long does the wholesale membership last?
Each time you send the $10 to your seller, you will receive 35 days added to your account.
When your account is reactivated, the 35 days are added to any remaining days you have left.
So you can buy as many months at a time as ayou like, because they accumilate.
If I try it for a month and decide to quit, how do I stop?
Just do nothing, send no payment and your wholesale membership will automatically expire.
All your referrals will then start buying from the next one in the upline.
Some payment processors offer automatic monthly payments, how come you don't use that option?
That option is great, but it wouldn't work here.
Here is an example why: what if you had not been a wholesale member, yet you had some people
in your downline that were and they were paying someone above you.
Then you became a wholesale member, wouldn't you want the people under you
to start paying you now. If we had the automatic payment, then the people under you
would continue to pay the same person who was above you.
How will I know when someone has paid me?
Generally the payment processor will send you an email, we will notify you when someone under you has become a wholesale member. You can then login to your payment processor's account and verify the payment.
What do I do when I receive a payment?
We will notify you when someone under you has become a wholesale member. You can then login to your Paypal, Alertpay or E-gold account and verify the payment. TopSurfer provides its service to you, subject to the following Terms of Service ("TOS"), which may be updated by us from time to time without notice to you. You can review the most current version of the TOS at any time. Also other rules may be posted in other areas which also are part of the TOS.
By using these services you accept all these terms and conditions without limitations.
SERVICES
TopSurfer Provides services "AS-IS". All services are provided without any guarantee.
Any credits whether free or purchased through TopSurfer are non-refundable, non-transferable, and non-redeemable.
TopSurfer can not be held responsible for miss-directed credits or credits incorrectly spent. All credits used are final.
ONLY ONE ACCOUNT IS ALLOWED PER WEBSITE/PERSON/HOUSEHOLD/COMPUTER/COMPANY (whatever the case may be).
Therefore:
* Each website can only have one account.
* Each company can only have one account.
* Each person can only have one account.
* Each household can only have one account.
* Each computer can only have one account.
The user agrees to not manipulate software or hardware to bypass any safeties or to bypass any terms or conditions set herein.
USER REGISTRATION
When an account is set-up, the user agrees to provide current and accurate information. And agrees that, that information can be used for TopSurfer to make contact with the user. Any inaccurate information may result in the user's account being closed.
Emails
As a member of TopSurfer you will receive emails from TopSurfer that are solo-advertisements from other TopSurfer members. You will receive hit credits for clicking the appropriate link in these emails.
There is no way to opt-out of these emails with out closing your account.
However, you can change the email address from your primary address so that the emails go to another account so that you can go through them later.
TOPSURFER'S PRIVACY POLICY
Information given to TopSurfer will not be sold or given to any third party without the users written permission, unless required to by law. Users agree not to collect or harvest any users information that may be on TopSurfer.com.
Some user information may be shared with other members of topsurfer.com, for example usernames, links, etc.
If you are a TopSurfer Wholesale Member your email address will be shared with your downline (referrals) so that they may contact you with questions about payment options, etc.
MEMBER ACCOUNTS AND PASSWORDS
The user agrees NOT to share personal passwords and any login information with others.
HIT DISTRIBUTION
TopSurfer makes no claim as to when hits will be received by the user. TopSurfer can not directly control how fast your hit credits will be used as this is dependent on how much the members surf. Incoming hits are split up among active members.
TopSurfer can not be held responsible for third party hit trackers that may be located on the user's site, and that may not record accurately the hits.
TopSurfers stats are final.
Hits are views and are not viewers/visitors. Some sites may be shown multiple times to users.

PRIZE DISTRIBUTION
TopSurfer may hold occasional contests where cash prizes will be awarded. Winners will be notified by email when they have won. The winner will then need to contact TopSurfer within 30 days or all prizes will be forfeited. It is therefore, the user's obligation to keep an active email account open. TopSurfer can not be held responsible for misdirected, undelivered, blocked or even unread email.
EARNING CASH BY SURFING
Members can earn money by surfing with the special surf bar for earning money. Members can earn .01 US (1 cent US) for every 35 sites surfed with the special surf bar. Members can request the a check be sent to them once their remaining cash total has reach $10 US DOLLARS. At any time cash can be converted by the member into hits.
All requests for cash and conversions must be done from within the member's area.
At no time and under no circumstances will hits be converted into cash.
TopSurfer has the right to withdraw any cash earned by any member that has broken any of these terms.
Accounts that are left inactive for 1 (one) year or more will forfeit any cash earned.
To have the cash sent to the member, the member must provide a correct address and name to TopSurfer.
TopSurfer has the right to verify information before sending any cash.
All members earning cash with the cash surfbar are required to fill out the appropriate IRS tax form before cash will be sent.

TopSurfer is under obligation by law to send an IRS form 1099 out for anyone earning more than $600 cash and TopSurfer has chosen to collect Tax ID numbers from anyone who earns money.
Any information gathered for payment purposes will be held safe and private by TopSurfer and falls within our standard Privacy Policy, shown above.
TopSurfer may at anytime, remove the surf bar to earn money. If TopSurfer removes the surf bar to earn money, any cash balances that have not reached $10 will be converted into hits. Accounts that are canceled by the member or by TopSurfer forfeits any cash earned by the user.
If a member is a current wholesale member, and the people that they have referred surfs using the money surfbar the member will earn .001 (1/10th of a cent) each time the referral earns money. The money will not be removed if the member's TopSurfer Wholesale Membership expires. This money follows the same rules as above and will need to reach $10 before it can be sent to the member. But it can be exchanged for hits at anytime.
MEMBER CONDUCT
While TopSurfer may take measures to prevent offensive information, the user acknowledges that any content found on TopSurfer.com (or it's associated sites: topsurfer2.com, go4sites.com) may not be controlled by TopSurfer, and TopSurfer can not be held accountable for it.
However, the user agrees not to use TopSurfer to promote or advertise any of the following material.
* Pornographic
* Links or banners to pornography
* Adult Content
* Explicit
* Racial
* Hate
* Illegal
* SPAM
* Auto-Surf Software or techniques
* Other start or surf pages where the user earns credits.
* Or any other material that may be offensive or unethical.
Users will conduct themselves in appropriate manner and will not manipulate any of the site to gain credit or access to unauthorized areas.
Also, TopSurfer does not allow the use of auto-surf software/hardware (etc.) to gain credits. Anyone caught using or distributing it will have their account terminated. Furthermore, users sites may not break out of TopSurfer frames, and users sites are only allowed one pop-up advertisement (including but not limited to: pop-ups, pop-unders, alerts, floating objects). Also, web pages must be primarily in the English language. TopSurfer has the full right to cancel or fine accounts/users for violating these terms. TopSurfer has the right to refuse to show websites at our discretion. Also TopSurfer has the right to refuse service to anyone.
INDEMNITY
The user agrees not to hold TopSurfer responsible for any content, links, advertisements, site malfunctions, miss-directions, viruses, spyware, adware or any other events that may cause harm mentally, physically or to property.
However, TopSurfer takes every method we can to prevent such problems. It is also up to members to report any sites that may be violating these terms.
Each surfbar provides a link where you can report another user's website.
MODIFICATIONS TO SERVICE
TopSurfer reserves the right at any time to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice. You agree that TopSurfer shall not be liable to you or to any third party for any modification, suspension or discontinuance of the Service.
TERMINATION
You agree that TopSurfer, in its sole discretion, may terminate your password, account (or any part thereof) or use of the Service, and remove and discard any Content within the Service, for any reason, including, without limitation, for lack of use or if TopSurfer believes that you have violated or acted inconsistently with the letter or spirit of these tems. TopSurfer may also in its sole discretion and at any time discontinue providing the Service, or any part thereof, with or without notice. You agree that any termination of your access to the Service under any provision of these terms may be effected without prior notice, and acknowledge and agree that TopSurfer may immediately deactivate or delete your account and all related information and files in your account and/or bar any further access to such files or the Service. ADVERTISEMENTS
Dealings with advertisers are done at your own risk and TopSurfer can not be held liable for any advertisers actions.

NO REFUNDS
TopSurfer offers no refunds for hits purchased or for credits applied or used.
SWITCHING UPLINES
Member's can switch their own uplines at anytime by using a form in the member's area. However there is a small charge to perform this change.
This fee is so that TopSurfer can make sure that the person switching is serious about the change and to make sure that the services are not manipulted.
All requests for upline changes are reviewed and manually approved or declined by an actual person. Any fees will be refund upon a decline. The new upline will not receive any bonus hits for referring the member in their downline (example: 100 free hits).
Nor are any of the TopSurfer Wholesale membership fees retroactive.
But the new upline will receive, the surfing hits from the member in their downline (example: 10% of the hits the referral earns). Also they would receive any future wholesale membership fees if applicable.
NO SPAM
Users can not use illegal or inappropriate means to promote TopSurfer.
This includes but is not limited to unsolicited email (SPAM).
Sending bulk emails to anyone that has not specifically requested information from the member personally.
Or in other words do not buy bulk "Opt-in" lists.
If the person did not specifically opt-in to receive emails from you specifically then you can NOT email them.
TopSurfer has zero tolerance for SPAM.
WHOLESALE MEMBERSHIP
TopSurfer offers a unique membership program, where the members themselves sell the membership.
TopSurfer, still owns the website, all it's scripts and hosting services. TopSurfer grants access to these areas with the following conditions and general rules:
TopSurfer will regulate the site but, is not responsible for member conduct in anyway.
TopSurfer can not be held liable for miss directed payments, payments not reembursed, or any other agreement made between the seller and buyer.
TopSurfer will not make any refunds of money that was not originally given to TopSurfer.
TopSurfer makes this general rule that NO refunds be made from the seller to the buyer except in these conditions:
The member who sent payment never received a wholesale membership account.
AND all (each individual) refund/reembursment/discount/etc must first be approved by TopSurfer,
any partial or full refunds/reembursments/discounts/etc will result in loss of services on TopSurfer.com.
DO NOT GIVE AWAY WHOLESALE MEMBERSHIPS!
All wholesale memberships must be exchanged/sold at full market value these cannot be given away.
The only discounts are those proposed by TopSurfer.com.
The scripts and services may not be manipulated to give away wholesale memberships.
TopSurfer is set up as a community where everyone contributes,
if someone manipulates TopSurfer in anyway that may cause damage to the entire community then we will suspend their account.
Giving away or excessivly discounting wholesale memberships is damaging to the community and is unfair to other members.
It can flood the pool of hits that need to be used which will cause all hits to be used slower.
If anyone finds someone giving away or discounting wholesale membership, more than what is offered on the site,
please report them immediately and we will reward the first person to report them with a free solo-ad credit.
Paying for wholesale memberships TopSurfer provides several ways to collect payments from their buyers for wholesale memberships. Including a miscelanious method that allows you to add a method of your choice as long as it fits into the script with the appropriate fields in it's buttons (so that the button can be changed dynamically by our scripts and prices, etc. can be changed depending on which package the person wants to buy). As a wholesale member you are required to use one or all of these services if you wish to sell wholesale memberships. You can not bypass these methods and use your own. You should not be paid directly. This system is meant to be automated and since you would receive 100% of the money and TopSurfer does not make any money from the upgrade, then this needs to be automated with little involvement from TopSurfer. Also to make sure the person is in your downline and to make sure that they should be paying you, all payments must go through the system/scripts at TopSurfer.
If you receive payment from a downline member and they did not use the automated method at TopSurfer, you should refund their money and ask them to go through the right methods.
In no circumstance should you falsify payment or method of payment.

CHEATING
All members will conduct themselves in a professional way and in no way will they try to defraud, or manipulate the programs to be unethical or unjust.
Any member found breaking any of the terms of service of TopSurfer.com may have their full membership in the wholesale program revoked and/or their accounts paused and/or their complete membership to all areas of TopSurfer removed without any refund being made.
ARBITRATION
TopSurfer maintains the right to make decisions, arbitrate, or intervene in disbutes over TopSurfer wholesale membership in all areas.
TopSurfer.com does not regulate wholesale membership payments made to members and can not be held responsible to make reports or decisions or take action based on other parties reports.
